Bundleby — Terms of Service

Welcome to Bundleby.
These Terms of Service ("Terms") explain the rules for using Bundleby — our website at bundleby.com (the "Site"), the curated experience bundles we sell ("Bundles"), and any related services we offer (together, the "Service"). "Bundleby", "we", "our", and "us" mean Bundleby Inc., a company based in Toronto, Ontario.
By using the Service or buying a Bundle, you agree to these Terms. If you don't agree, please don't use the Service. Please also read our Privacy Policy, which explains how we handle your information.
1. What Bundleby is (and isn't)
Bundleby curates experiences from independent local businesses ("Merchants") into ready-made, bookable Bundles — typically a multi-stop outing combining two or more venues at a single price.
We are a facilitator, not the venue. When you buy a Bundle, you are purchasing the right to redeem a set of experiences delivered by the Merchants in that Bundle. The actual experiences — the restaurant, the arcade, the studio, the activity — are operated by those Merchants, not by us. We curate, package, sell, and support the Bundle; the Merchant delivers the experience and is responsible for it. (See Section 10.)
2. Who can use the Service
You must be at least 18 years old and able to enter a binding contract. By using the Service you confirm you are.
Some experiences within a Bundle may have their own age, health, safety, or identification requirements set by the Merchant. You're responsible for meeting those requirements; if you don't, the Merchant may refuse the experience, and that's between you and the Merchant. Alcohol has its own rules — see Section 7.
3. No account required
You don't need to create an account to buy or redeem a Bundle. You purchase as a guest, and we'll send you a confirmation (such as an email or a redemption code) that you present at the venue to redeem your Bundle.
When you check out, please give accurate information so we can deliver your confirmation and contact you about your order. Keep your confirmation or redemption code secure — anyone with it may be able to redeem your Bundle.
4. Buying and redeeming Bundles
Prices are shown in Canadian dollars (CAD). The amount you pay is the price shown for the specific Bundle you select at checkout. Any applicable taxes are handled in accordance with Canadian tax law.
A Bundle is a dated booking. Each Bundle is for a specific date you select at checkout. That selection is your booking, and the Merchants reserve your place for that date and time. A Bundle entitles you to the specific experiences described on its Bundle page, subject to the conditions listed there (date and time, what's included, what's extra, and any Merchant requirements).
Redemption. After purchase you'll receive one or more single-use redemption codes. Present each code at the relevant venue on your selected date to redeem that stop. Each Bundle page tells you how redemption works for that Bundle.
Validity. Your Bundle is valid for the date you selected at checkout. If, for any reason, any part of what you bought functions as prepaid or gift-card-type value, your rights under Ontario law regarding prepaid purchases and gift cards continue to apply, and we won't expire that value in a way that breaks those laws.
5. Payments
We use Stripe, Inc. to process payments, including Stripe Connect to pay Merchants directly. By paying, you agree to Stripe's terms and authorize Stripe to charge your chosen payment method. We don't store your full card details. You confirm the payment information you give is accurate and that you're authorized to use the payment method.
6. Cancellations, rescheduling and refunds
Each Bundle is a pre-paid experience for a specific date you select at checkout. Because your place is reserved with the Merchants for that date, the following applies:
Same-day and last-minute bookings are final. If you book for the same day, or within 48 hours of your selected date, your purchase is non-refundable and cannot be rescheduled, because the Merchants begin preparing for your arrival right away.
Rescheduling. If you notify us more than 48 hours before your selected date, we will reschedule your Bundle to another available date, subject to availability at both venues. Email hello@bundleby.com. Rescheduling is offered as a courtesy and isn't guaranteed if no suitable date is available.
No general right of refund. Except as required by law or as set out below, Bundles are non-refundable once purchased. We don't offer refunds for change of mind, no-shows, late arrival, or failure to meet a Merchant's own age, health, identification, or conduct requirements.
Single-use codes. Redemption codes are single-use. Once a code has been redeemed at either stop, that Bundle cannot be refunded or rescheduled. Partially redeemed Bundles are non-refundable for the redeemed portion, since that experience was already delivered.
If we or a Merchant cannot deliver. If a Bundle or a Merchant becomes unavailable before you redeem, or a Merchant fails to honour your Bundle when you arrive correctly, on time, and meeting the stated requirements, contact us at hello@bundleby.com, and we'll make it right — a reschedule, a replacement of equivalent value, or a refund of the affected portion, at our reasonable discretion.
Your legal rights. Nothing in these Terms removes or limits any refund or cancellation right you have under Ontario's Consumer Protection Act, 2002 (or successor legislation, including the Consumer Protection Act, 2023 as it comes into force) or other applicable law. Where the law gives you a right we appear to exclude, the law applies.
7. Alcohol and age
You must be at least 18 to purchase a Bundle and enter these Terms.
Some Bundles include an alcoholic beverage. Alcohol is served solely by the licensed Merchant, under the Merchant's own liquor licence, to guests who are 19 or older with valid ID, and at the Merchant's discretion in line with its responsible-service obligations. Bundleby does not sell, serve, or supply alcohol.
If you can't show valid proof of age, or the Merchant declines service under its licence or responsible-service obligations, no refund is due for the beverage portion, and that is a matter between you and the Merchant. A non-alcoholic option is available in every Bundle.
8. Food and allergens
Bundle dishes are fixed and are prepared by the Merchant. If you have allergies or dietary restrictions, you are responsible for choosing a suitable Bundle before purchase and for informing the Merchant's staff when you arrive. Bundleby doesn't prepare food and isn't responsible for the Merchant's food preparation, ingredients, or handling.
9. Your content
If you post reviews, photos, or other content ("User Content"), you keep ownership of it. You give us a non-exclusive licence to display and use it to operate and promote the Service. You confirm you have the rights to anything you post and that it doesn't break the law or anyone else's rights. We can remove content that's unlawful, harmful, or off-policy.
If we photograph or film a Bundle experience you're attending and you'd prefer not to appear, tell us and we won't use your likeness.
10. Merchants and third-party venues
Experiences in a Bundle take place at venues owned and run by independent Merchants. We curate and vet our partners, but:
We don't control how a Merchant runs its venue, and we're not responsible for the Merchant's own conduct, products, food, drink, or premises.
Your participation in an experience is at your own risk, subject to the Merchant's own rules, licences, and waivers, and to the standards required of the Merchant by law. The Merchant is responsible for the safety of its premises, its food and drink service, and its compliance with applicable licensing and health-and-safety law.
If something goes wrong at a venue, tell us — we'll help where we can and stand behind the Bundle you bought from us, as described in Section 6.
11. Acceptable use
Don't: break the law using the Service; impersonate others; scrape or copy our Bundle content or curation; use our brand without permission; interfere with the Service; or use the Service to build or benchmark a competing product. Our curated Bundle pages are our work — please don't lift them.
12. Our intellectual property
The Site, the Bundleby brand, and our curated Bundle content are owned by us or our licensors. You may use them only as these Terms allow.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect and use personal information in line with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). We take reasonable steps to protect your information but can't guarantee perfect security.
14. Disclaimers
The Service is provided "as is." To the extent the law allows, we don't warrant that the Service will be uninterrupted, error-free, or that every Bundle detail is always perfectly accurate. This does not exclude any warranty or right that cannot be excluded under Ontario or Canadian law.
15. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability to you for any claim relating to the Service is limited to the greater of the amount you paid us for the relevant Bundle or CAD $500.
Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited under applicable law.
16. Indemnity
You agree to cover us for losses arising from your misuse of the Service, your breach of these Terms, your User Content, or your violation of someone else's rights — to the extent those losses are actually caused by you.
17. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. You agree that disputes will be handled by the courts of Ontario, except for any rights you have to bring a claim in small claims court or under consumer protection law.
18. Changes to these Terms
We may update these Terms. If we make a significant change, we'll let you know (for example, by notice on the Site or by email). Continuing to use the Service after a change means you accept it.
